Acceptance of Terms

By accessing our website, requesting a quotation, or engaging with our products or services, you ("Client", "Customer", or "User") agree to be bound by these Terms & Conditions. These terms apply to all commercial dealings unless otherwise specified in a mutually signed agreement.

Scope of Services

Signature Racking Systems provides engineering, design, fabrication, delivery, and installation of:

  • Industrial Racking Systems
  • Mezzanine Floors
  • Structural Steel Works
  • Warehouse Automation and Accessories
  • Turnkey Storage and Material Handling Solutions

All services are delivered as per technical drawings, BOQs, and project-specific terms outlined in contracts, quotations, or LPOs.

Quotation & Pricing

All quotations are valid for 30 days unless specified otherwise in writing.

Prices are exclusive of VAT, duties, permits, or import taxes unless explicitly stated.

Signature Racking reserves the right to revise pricing in the event of:

  • Raw material cost fluctuations
  • Scope modifications
  • Delays beyond our control (e.g., client-side site readiness or permit issues)

A quotation becomes binding only upon written acceptance and confirmed advance payment.

Orders & Contracts

A valid order requires written confirmation via signed quotation or purchase order.

Any amendments or change requests must be made in writing and are subject to revised costing and delivery timelines.

All drawings and layout approvals must be formally signed before fabrication begins.

Signature Racking reserves the right to decline any order deemed commercially or technically infeasible.

Payment Terms

Unless agreed otherwise in writing:

Advance Payment: 50% upon order confirmation

Progress Payment: 40% upon delivery to site or partial installation

Final Payment: 10% upon handover or completion certificate

All payments are due within the timeline specified on the invoice. Late payments may incur a 2% monthly interest or delayed execution.

Delivery & Installation

Delivery dates are estimates and subject to material availability, logistics, and site readiness.

Installation timelines assume uninterrupted access and a prepared site.

Any delay due to external factors (e.g., power outage, permit delay, third-party interference) will extend the project schedule without penalty.

Signature Racking is not responsible for delays caused by force majeure, including natural disasters, strikes, or supply chain disruption.

Client Obligations

The Client agrees to:

  • Provide timely access to site and utilities (electricity, lifts, permits, etc.)
  • Review and approve drawings and documents without undue delay
  • Ensure safe and clear working conditions
  • Designate a single point of contact for project coordination
  • Notify us immediately of any deviation or defect discovered during or after installation

Warranties & Limitations

Signature Racking offers a 12-month warranty on manufacturing defects for racking systems and structural steel, excluding wear-and-tear, overloading, or misuse.

Warranty is void if unauthorized modifications, repairs, or relocations are made.

Components from third-party vendors (e.g., automation systems) are covered under their respective warranties.

We do not warrant performance under unusual or site-specific loads unless explicitly stated in writing.

Intellectual Property

All engineering designs, shop drawings, calculations, photos, and marketing materials remain the exclusive intellectual property of Signature Racking Systems.

Unauthorized copying, reuse, or sharing is strictly prohibited.

Signed NDAs or confidentiality clauses may be applicable for custom projects or strategic partnerships.

Liability Limitation

Our liability is strictly limited to repair, replacement, or refund (up to the contract value) in case of proven negligence.

We are not liable for indirect, incidental, or consequential damages, including business loss, revenue loss, downtime, or storage inefficiencies.

Clients are responsible for validating load capacities and racking specifications based on their operational needs unless advised by our certified engineer.

Subcontracting & Third Parties

Signature Racking may use subcontractors or third-party service providers for manufacturing, transport, and installation.

All partners are vetted and operate under binding confidentiality and performance agreements.

Compliance with Laws

We ensure compliance with applicable UAE Civil Code, Sharjah Municipality Guidelines, Fire Safety Codes, and ESMA regulations.

Clients must ensure relevant permits, approvals, and inspections are obtained from authorities having jurisdiction.

Dispute Resolution

All efforts shall be made to resolve disputes amicably through negotiation.

Failing that, disputes shall be resolved under the jurisdiction of the Courts of Sharjah, UAE.

The governing law shall be the Civil Laws of the United Arab Emirates.

Amendments & Termination

Signature Racking reserves the right to revise these terms with prior notice.

Either party may terminate a project if the other party fails to perform, after 14 days' written notice and an opportunity to cure.

Upon termination, all executed work and expenses will be invoiced and payable immediately.
